Understanding the Scope of Our Services
Our primary expertise and service offering at Carroll’s Building Materials encompass the mixing, delivery, and pumping of concrete. It’s important to highlight that our services strictly stop at this point: we deliver and pump the concrete to your specified location.

We want to be absolutely clear that our services do not include concrete finishing work. This task involves the shaping, smoothing, or finalizing the setup of the concrete once it has been pumped. Concrete finishing is a separate trade requiring its own set of skills and techniques.

Given the specialized nature of concrete finishing, we strongly advise that you engage a professional concrete finishing service or a skilled individual for the final steps of your project. This will ensure a high-quality finish to your concrete and a seamless transition from our delivery to the completion of your project.

Important Considerations for Freshly Poured Concrete
It is crucial to understand that freshly poured concrete may exhibit certain behaviors as it cures.

These behaviors include:

Discoloration: The color of the concrete may change over time due to various factors such as weather, the quality of the mix, and other environmental factors.
Shrinkage: Concrete can decrease in volume as it dries, which can lead to shrinkage cracks.
Cracking: As concrete hardens, it may develop cracks due to temperature changes, improper curing, or stress.
Crazing: Fine, shallow cracks may form on the surface of the concrete, creating a pattern that resembles cracked glass. This is usually caused by rapid drying of the surface.
These are natural occurrences in the curing process and are not indicative of faulty material or workmanship.

Clean Work Area Requirement
For a successful concrete pour, it’s essential that the work area is clean and free from obstructions, including piles of dirt. Dirt can mix with the fresh concrete and create complications. Therefore, the customer is responsible for ensuring the work area is clean and ready for the concrete pour.

Non-returnable and Non-refundable Nature of Concrete
We would like to remind our customers that due to the specific nature of concrete, it cannot be returned once it has been mixed and delivered. Therefore, we cannot offer refunds for any concrete provided.

Your Responsibility
As our valued customer, you will be responsible for arranging all necessary concrete finishing work following the delivery and pumping services provided by Carroll’s Building Materials. This will ensure a smooth transition from our delivery to the finishing phase of your project.

Agreement to Terms
By engaging the services of Carroll’s Building Materials, you acknowledge that you have read, understood, and accepted these terms and conditions. You accept that concrete can exhibit natural behaviors such as discoloration, shrinkage, cracking, and crazing, and that you understand the non-returnable and non-refundable nature of concrete.

Governing Law
This agreement and any dispute or claim arising out of or in connection with it shall be governed by and construed in accordance with the laws of the State of Florida, Pinellas County.

Concrete Terms & Conditions:
Concrete Quality After Delivery – Our responsibility for the quality of the concrete ends when the product is delivered and accepted at the job site. Any deterioration in the quality of the concrete due to environmental conditions, misuse, or incorrect installation after delivery is not our responsibility.

Delivery Access – The purchaser is responsible for providing clear and safe access to the job site. If the access provided is unsuitable or unsafe, we reserve the right to refuse delivery. Any additional costs incurred due to unsuitable or unsafe access will be the responsibility of the purchaser.

Added Ingredients – The purchaser assumes all responsibility for the strength, slump, and quality of the concrete when additional water and/or other ingredients are requested on the job. Any alterations made to the concrete mixture may affect its performance and no refunds or chargebacks will be accepted for any consequences resulting from such alterations.

Detention of Trucks on Job Site – Purchaser will be allowed a total of 15 minutes free unloading time for the first cubic yard of concrete and an additional 10 minutes free unloading time for each subsequent cubic yard. Delays caused by the purchaser exceeding the allotted time will be charged at the rate of $2.00 per minute. Delays in delivery due to unforeseen circumstances such as traffic and/or weather conditions are not under our control and will not result in any form of compensation or refund to the purchaser.

Curb Release – All orders are for street delivery only. A fully-loaded mixer truck carries significant weight (in excess of 74,000 lbs.) and may potentially cause damage to driveways, sidewalks, septic tanks, water meters, power lines, curbs, grass, and plants if delivery is made inside the curb. The undersigned assumes all responsibility and liability for any and all damage incurred when delivery is made inside the curb line.

Limitation of Liability – In no event shall our company be liable for any indirect, incidental, special, exemplary, or consequential damages arising out of or in connection with the delivery and use of the concrete, including, without limitation, any damages resulting from loss of use, data, or profits, whether or not we have been advised of the possibility of such damages.

Indemnification – The purchaser agrees to indemnify, defend, and hold harmless our company, its owners, employees, and agents from any and all claims, liabilities, damages, and/or costs (including, but not limited to, legal fees) arising from or related to: misuse of the product, violation of these terms, or violation of any rights of a third party.

Confirmation of Services – The purchaser acknowledges and agrees that they have received all products and/or services as stated on this invoice in full satisfaction. By accepting the delivery/ and or receipt of these terms of agreement, they waive any right to initiate a chargeback or dispute with my bank or credit card company.

Chargeback Responsibility – In the event of a customer-initiated chargeback or dispute with a bank or credit card company, the undersigned agrees to be solely responsible for all associated fees and costs, including but not limited to administrative fees, arbitration fees, and any legal fees we may incur in relation to the chargeback. Furthermore, we reserve the right to recover these costs by any legal means necessary, including by placing a lien on the property where the concrete was delivered, subject to local laws and regulations.

Job Clean-Up – Purchaser confirms that they have thoroughly inspected the street and/or pour area(s) and agree that the pour site(s) have been cleaned to satisfaction. They acknowledge that any claims related to the cleanliness of the site after this point are null and void.
